These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Esencja / Zordon Hub Operations regarding your access to and use of the website [esencja.app](https://esencja.app), our APIs, and our companion iOS applications. By accessing, browsing, or using the Service, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree to these Terms, you must immediately discontinue using the Service. --- ## 1. Description of the Service Esencja is an intellectual synthesis and learning accelerator platform. We produce original, human-curated editorial syntheses, chapter analyses, four-tier knowledge condensations (60-second hook, 5-minute executive summary, 15-minute key insights, and deep chapter breakdowns), interconnected concept graphs, and spoken-word audio companions covering non-fiction literature in business, psychology, science, leadership, and personal growth. --- ## 2. Intellectual Property, Transformative Commentary & Disclaimers ### A. Original Editorial Nature All book summaries, syntheses, critical reviews, takeaways, mental models, and knowledge architecture published on Esencja are **original, independent editorial works** created by our editorial team. * **Form and Expression:** We formulate our syntheses entirely in our own words, employing independent analytical structures, original categorization, and synthesized takeaways. We do not copy, translate, or reproduce full book manuscripts, chapters, or proprietary text. * **No Substitution:** Our syntheses are designed as educational companions, study guides, and conceptual roadmaps. They are **not substitutes for reading or purchasing the complete original works**. We actively encourage our users to buy and read the full publications of the authors we discuss. ### B. Bibliographical Attribution & Nominative Fair Use All book titles, author names, publishers, ISBNs, and publication years are factual bibliographical information referenced solely for descriptive, identification, and educational purposes. Statutory Quotation Right & Fair Use Where verbatim quotations from an original book are incorporated, they are strictly limited to short, marked phrases necessary for critical discussion, context, or illustration. Such use is carried out in strict accordance with statutory quotation rights under **Article 29(1) of the Polish Act of 4 February 1994 on Copyright and Related Rights**, Article 5(3)(d) of EU Directive 2001/29/EC, and Section 107 of the U.S. Copyright Act (Fair Use). Notice and Takedown Policy (Copyright Agent & 72-Hour SLA) We respect the intellectual property rights of creators and publishers. A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law. 4. Your contact information (name, address, telephone number, and email address). 5. A statement made under penalty of perjury that the information in the notification is accurate and that you are the copyright owner or authorized to act on their behalf. 6. A physical or electronic signature. ### 72-Hour Response SLA & Takedown-First Policy: Upon receipt of a valid notice fulfilling statutory criteria, Esencja maintains a strict **takedown-first policy**: we will review the claim, temporarily suspend or retire public availability of the contested summary within **72 hours**, and communicate directly with the claimant. --- ## 4. User Conduct, Permitted Use & Prohibited Acts You are granted a limited, personal, non-exclusive, non-transferable, and revocable license to access and read content on Esencja for personal, educational, non-commercial purposes. **You explicitly agree NOT to:** 1. **Scrape or Harvest:** Use any robot, spider, crawler, scraper, data mining tool, or automated methodology to bulk-extract, download, or index our summaries, audio files, or concept graphs, except for bona fide search engines complying with our `robots.txt` directives. 2. **AI Training / Model Extraction:** Scrape, ingest, or extract content from Esencja for the purpose of training, fine-tuning, or evaluating machine learning models, large language models (LLMs), or commercial AI tools without a written commercial licensing agreement. 3. **Redistribute or Resell:** Resell, sublicense, re-publish, broadcast, or commercialize our editorial text or audio assets. 4. **Circumvent Protections:** Bypass, disable, or tamper with any technological protection measures, DRM, rate-limiting, or security headers. 5. **Denial of Service:** Engage in any activity that disrupts or burdens the infrastructure, servers, or networks connected to the Platform. --- ## 5. Mobile Subscriptions, In-App Purchases & Payments * **Web Platform Access:** Core book summaries, 4-tier conceptual breakdowns, and web audio previews are provided free of charge for online reading. * **Native iOS Mobile App:** Advanced features (offline audio downloads, background lock-screen playback, widgets, premium collections) may require a paid auto-renewing subscription via Apple In-App Purchase ("Esencja Pro"). * **Billing via Apple:** All subscriptions purchased via our iOS app are billed through and managed exclusively by Apple Inc. Cancellation, refunds, and renewal settings are governed by Apple Media Services Terms and Conditions. You may cancel renewal at any time in your iOS Device Settings (`Settings > Apple ID > Subscriptions`). --- ## 6. Disclaimers & No Professional Advice THE SERVICE AND ALL CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. * **Educational Nature Only:** Content on Esencja represents editorial summaries of concepts formulated by various authors. OUR AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL BE STRICTLY LIMITED TO THE GREATER OF (A) THE TOTAL AMOUNT PAID BY YOU TO ESENCJA IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED EUROS (€100). 3. NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY FOR FRAUD, WILLFUL MISCONDUCT, DEATH, OR PERSONAL INJURY CAUSED BY NEGLIGENCE, OR ANY MANDATORY CONSUMER RIGHTS UNDER POLISH OR EUROPEAN CONSUMER LAW THAT CANNOT BE DEROGATED FROM BY CONTRACT. --- ## 8. Governing Law & Dispute Resolution These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the **laws of the Republic of Poland**, without giving effect to any principles of conflicts of law. * **Consumer Protections:** If you are an individual consumer residing in the European Union, you also benefit from mandatory provisions of the consumer protection laws of your country of habitual residence. * **EU Online Dispute Resolution (ODR):** The European Commission provides an online dispute resolution platform for consumers, accessible at: [https://ec.europa.eu/consumers/odr](https://ec.europa.eu/consumers/odr). We are neither obligated nor willing to participate in dispute settlement proceedings before a consumer arbitration entity unless mandated by law. * **Jurisdiction:** For non-consumer commercial entities, the courts located in Warsaw, Poland shall have exclusive jurisdiction over any disputes. --- ## 9. Severability & Entire Agreement If any provision of these Terms is found to be unlawful, void, or for any reason unenforceable, that provision will be deemed severable and will not affect the validity and enforceability of any remaining provisions.
